Terms of Use

Welcome to Petal Plant Garden ("Petal"). These Terms of Use ("Terms") form a binding agreement between you and Kinsman ("we", "our", or "us") regarding your use of the Petal iOS application and any related services (the "App"). By installing or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. License

We grant you a limited, non‑exclusive, non‑transferable, revocable license to use the App on Apple‑branded devices that you own or control, in accordance with the Apple Media Services Terms and the Usage Rules in the App Store Terms.

2. Subscriptions & In‑App Purchases

Petal also offers one‑time non‑subscription purchases (additional plant slots) at the prices shown in the App at the time of purchase.

Auto‑renewal

• Your subscription renews automatically at the end of each period unless auto‑renew is turned off at least 24 hours before the end of the current period.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscription in iOS Settings > Apple ID > Subscriptions. No partial refunds are provided for the unused portion of a term.
• Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.

3. Acceptable Use

You agree not to:

• Post unlawful, harassing, hateful, or sexually explicit content in the community.
• Impersonate other users or claim usernames in bad faith.
• Attempt to disrupt, reverse engineer, or compromise the security of the App or its servers.
• Use the App to spam, scrape, or solicit other users.

We reserve the right to remove content and terminate accounts that violate these rules.

4. Your Content

You retain ownership of the content you create in Petal (plant entries, photos, journal notes, community posts). By posting content to the community, you grant us a worldwide, royalty‑free license to host, display, and distribute that content within Petal solely to operate the community feature. You can delete your community content at any time.

5. Disclaimer

Petal provides plant‑care information for general reference only. We do not guarantee the accuracy of plant care recommendations and are not responsible for the health of your plants. Use your own judgement and consult expert sources when needed.

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.

6. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Our total aggregate liability for any claim relating to the App will not exceed the amount you paid us in the twelve months preceding the claim, or US$50, whichever is greater.

7. Apple‑Specific Terms

You acknowledge that these Terms are between you and us only, and not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of a failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is a third‑party beneficiary of these Terms and may enforce them against you.

8. Privacy

Your use of the App is also governed by our Privacy Policy.

9. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date will reflect the most recent change. Continued use after a change indicates your acceptance.
